Employers and cell phones: What are the liability issues?

Reducing the risk of a lawsuit necessitates that a business owner enforce policies that not only protect the employee, but also the public at large. When was the last time you reviewed your policy for employees’ use of cellphones while on the job?

One way to reduce, but not eliminate liability concerns, is to equip employees with hands-free cellular devices. Another step towards reducing potential automobile accidents among your staff is to conduct training sessions that reinforce safe behaviors when behind the wheel.

If you’ve had the unpleasant task of terminating an employee, encourage the person to not fly out the door in a state of distress. Do everything you can to keep them off the road until they appear to have their emotions under control. Offer to take them out to a cafe with a private booth and let them work through the anxiety of losing their job. Or, call their friend or relative to ensure they have someone who can safely drive them home.

One related issue involving cellular and wireless technology is an employee’s fears of learning a new interface for the equipment they must use on the job. For baby boomers in particular, they may need some extra time to feel comfortable with the company’s mobile and wireless technology. A low-stress training program that familiarizes employees with the company’s equipment is a good idea.
